Terms of Service
Version 2.0 — Effective from 10/04/2026
Please read these Terms of Service carefully before using ManaSmurti. By creating an account or using the service in any manner, you agree to be bound by these terms in their entirety.
1. Definitions
In these Terms of Service, unless the context otherwise requires:
- "ManaSmurti", "we", "us", or "our" refers to ManaSmurti, a product designed and developed by Rakesh Krishnan, operating from Bangalore, Karnataka, India.
- "Platform" refers to the ManaSmurti website, web application, and all associated services accessible at manasmurti.com.
- "User", "you", or "your" refers to any individual who accesses or uses the Platform, whether registered or not.
- "Content" refers to all text, messages, data, information, and materials submitted by you or generated by the Platform during your use of the service.
- "Services" refers to all features, functionalities, and capabilities offered by ManaSmurti, including but not limited to the companion chat, exercises, and related tools.
- "Subscription" refers to a paid plan that grants access to additional features and higher usage limits on the Platform.
2. Acceptance of these terms
These Terms of Service constitute a legally binding agreement between you and ManaSmurti. By registering an account, logging in, accessing, browsing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these terms and all policies incorporated herein by reference, including our Privacy Policy, Refund Policy, Cookie Policy, and Disclaimer.
If you do not agree with any provision of these terms, you must not use ManaSmurti. Continued use of the Platform after any amendment to these terms shall constitute your acceptance of the amended terms.
If you are using ManaSmurti on behalf of an organisation (including under a corporate plan), you represent and warrant that you have the authority to bind that organisation to these terms, and references to "you" shall include that organisation.
3. What ManaSmurti is and what it is not
ManaSmurti is a companion platform designed to help you think through situations, organise your thoughts, and feel heard during difficult moments. It provides a private, judgment-free space for reflection and self-expression.
ManaSmurti is NOT any of the following:
- A medical service, healthcare provider, or mental health treatment facility.
- A replacement for therapy, counselling, psychiatric care, or any form of professional mental health intervention.
- A source of medical, legal, financial, tax, investment, or any other professional advice.
- A crisis intervention, suicide prevention, or emergency response service.
- A diagnostic tool for any physical, psychological, or psychiatric condition.
All responses on ManaSmurti are generated by automated algorithms. These responses may be inaccurate, incomplete, misleading, or not suited to your specific situation. You must not treat any response from ManaSmurti as professional advice. Always consult a qualified professional before making important decisions about your health, finances, legal matters, or personal safety.
If you are in a crisis, experiencing thoughts of self-harm or harming others, or are in any emergency situation, you must contact emergency services or a crisis helpline immediately. Do not rely on ManaSmurti in an emergency under any circumstances.
4. Eligibility
You must be at least 18 years of age to use ManaSmurti. By creating an account, you represent and warrant that you are 18 years of age or older and that you have the legal capacity to enter into this agreement.
ManaSmurti requires date of birth verification at the time of registration. If we discover or have reasonable grounds to believe that a user is under 18 years of age, we will immediately terminate the account and permanently delete all associated data without prior notice to the user.
If you are a parent or guardian and believe a minor under your care has created an account on ManaSmurti, please contact us immediately at grievance@manasmurti.com.
5. Your account and responsibilities
When you create an account on ManaSmurti, you agree to the following:
- You will provide accurate, current, and truthful information during registration and keep your profile information updated.
- You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password.
- You will not share your account credentials with any other person or allow any other person to access your account.
- You will notify us immediately at support@manasmurti.com if you suspect any unauthorised access to or use of your account.
- You accept full responsibility for all activities that occur under your account, whether authorised by you or not.
Each account is strictly for individual use only. You may not create multiple accounts for the same person, and you may not transfer or assign your account to any other individual.
ManaSmurti shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.
6. Acceptable use policy
You agree that you will not use ManaSmurti in any of the following ways:
- To submit false, misleading, defamatory, or harmful content.
- To attempt to deceive, manipulate, or extract information that could be used to harm yourself or others.
- To use the Platform for any unlawful, illegal, or fraudulent purpose.
- To attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code, algorithms, or underlying technology of the Platform.
- To scrape, crawl, or access the Platform through automated means (bots, spiders, scrapers) without our prior written permission.
- To impersonate any person or entity, or to misrepresent your identity or affiliation with any person or entity.
- To interfere with, disrupt, or compromise the security, integrity, or performance of the Platform or its infrastructure.
- To upload, transmit, or distribute any viruses, malware, or other harmful code.
- To use the service in any manner that could damage, disable, overburden, or impair ManaSmurti or interfere with any other party's use of the Platform.
- To collect or harvest any information about other users without their explicit consent.
- To use ManaSmurti to generate content for commercial resale, publication, or redistribution without our prior written consent.
Violation of this acceptable use policy may result in immediate suspension or permanent termination of your account, without prior notice and without refund of any fees paid.
7. Community guidelines and prohibited conduct
ManaSmurti is intended to be a safe and supportive space for everyone. To maintain this environment, all users must observe the following guidelines.
The following conduct is strictly prohibited on ManaSmurti:
- Sexually explicit conversations, requests, or content of any kind.
- Harassment, hate speech, abuse, threats, or intimidation directed at any person, group, community, or category of individuals.
- Content that promotes or glorifies violence, terrorism, or illegal activities.
- Requesting information with the intention to cause harm to yourself or others.
- Attempting to manipulate, circumvent, or work around ManaSmurti's safety guidelines or content policies.
- Spamming, flooding, or deliberately misusing the service in any manner.
- Sharing personal information of other individuals without their consent.
Enforcement process:
We follow a progressive, step-by-step enforcement process before taking any serious action against a user account.
- First occurrence: You will receive a warning and a reminder of our community guidelines. No access restriction is applied.
- Second occurrence within 30 days: A 24-hour temporary suspension will be placed on your ability to start new conversations. Your account and all data remain intact during this period.
- Third occurrence within 30 days: Your account will be permanently suspended. Any active subscription will be cancelled immediately, and no refund will be issued for the current or any remaining billing period.
A 30-day period without any violations will reset your strike count.
Appeals: If you believe an enforcement decision was made in error, you may file an appeal by emailing grievance@manasmurti.com. We review every appeal and respond within 48 hours.
ManaSmurti reserves the right to bypass the progressive enforcement process and immediately suspend or terminate any account in cases of severe violations, including but not limited to content that threatens the safety of any individual or that involves illegal activity.
8. Intellectual property
Our intellectual property: The ManaSmurti name, logo, brand elements, website design, user interface, source code, algorithms, software, and all associated intellectual property are owned exclusively by ManaSmurti and its creator, Rakesh Krishnan. These are protected under the applicable laws of India, including the Copyright Act, 1957, the Trade Marks Act, 1999, and the Information Technology Act, 2000.
You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Platform, except as incidentally necessary for your personal, non-commercial use of the service.
Your content: You retain ownership of the messages and content you submit to ManaSmurti. By submitting content, you grant ManaSmurti a limited, non-exclusive, royalty-free licence to process, store (in encrypted form), and use your content solely for the purpose of providing you with the companion service. This licence terminates when you delete your account or the relevant content.
Generated responses: Responses generated by ManaSmurti are produced by automated algorithms and are provided to you for your personal use only. You may not reproduce, publish, or commercially exploit any generated response without our prior written consent.
9. Subscription and billing
ManaSmurti offers a free tier with limited usage and paid subscription plans with enhanced features and higher usage limits. All paid plans are billed in Indian Rupees (INR).
- Auto-renewal: Paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You authorise ManaSmurti to charge your payment method on file for each renewal.
- Cancellation: You may cancel your subscription at any time from your account settings. Upon cancellation, your access to paid features will continue until the end of the current billing period, after which your account will revert to the free tier.
- Price changes: We will notify you at least 30 days in advance of any changes to subscription pricing. The revised pricing will apply from your next billing cycle after the notice period.
- Taxes: All prices are inclusive of applicable taxes, including GST (Goods and Services Tax) as applicable under Indian law.
- Failed payments: If a payment fails, we will attempt to charge your payment method up to three times over a period of seven days. If all attempts fail, your subscription will be cancelled and your account will revert to the free tier.

Payment processing is handled by our authorised payment gateway partner. ManaSmurti does not store your card number, bank account details, or UPI credentials on its servers. All payment data is handled in accordance with PCI-DSS standards by our payment processor.
10. Disclaimer of warranties
The Platform and all Services are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by applicable law, ManaSmurti expressly disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that the Platform will be uninterrupted, timely, secure, or error-free.
- Any warranty regarding the accuracy, reliability, completeness, or suitability of any response generated by the Platform.
- Any warranty that defects in the Platform will be corrected.
- Any warranty that the Platform is free from viruses, bugs, or other harmful components.
No advice or information, whether oral or written, obtained by you from ManaSmurti or through the Platform shall create any warranty not expressly stated in these terms.
11. Limitation of liability
To the maximum extent permitted by applicable law, ManaSmurti, its creator, employees, agents, partners, and service providers shall not be liable for any of the following, whether arising from contract, tort (including negligence), strict liability, or any other legal theory:
- Any indirect, incidental, special, consequential, punitive, or exemplary damages.
- Loss of profits, revenue, data, goodwill, or business opportunity.
- Any damage arising from your reliance on any response, information, or content provided by the Platform.
- Any damage arising from unauthorised access to or alteration of your data or transmissions.
- Any damage arising from interruption, suspension, or termination of the Platform or your access to it.
- Any damage arising from the conduct or content of any third party on or in connection with the Platform.
In no event shall the total aggregate liability of ManaSmurti to you for all claims arising out of or related to these terms or your use of the Platform exceed the total amount you have paid to ManaSmurti in subscription fees during the six (6) months immediately preceding the event giving rise to the claim, or One Thousand Indian Rupees (INR 1,000), whichever is greater.
The limitations set forth in this section shall apply regardless of whether ManaSmurti has been advised of the possibility of such damages and regardless of whether any remedy fails of its essential purpose.
Nothing in these terms shall exclude or limit liability that cannot be excluded or limited under applicable Indian law.
12. Indemnification
You agree to indemnify, defend, and hold harmless ManaSmurti, its creator, employees, agents, and service providers from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of or access to the Platform.
- Your violation of these Terms of Service or any applicable law.
- Your violation of any rights of a third party.
- Any content you submit to or through the Platform.
- Your negligent or wrongful conduct.
This indemnification obligation shall survive the termination of your account and these Terms of Service.
13. Account termination
Termination by you: You may close your account at any time from your account settings. Upon closure, your access to the Platform will cease immediately, and your data will be deleted in accordance with our Privacy Policy.
Termination by us: We reserve the right to suspend or terminate your account, without prior notice and without liability to you, if:
- You breach any provision of these Terms of Service.
- We detect fraudulent, abusive, illegal, or harmful activity on your account.
- Continued operation of your account poses a risk to the Platform, its infrastructure, or other users.
- We are required to do so by law or by a lawful order from a competent authority.
- We discontinue the Platform or any part of the Services.
Upon termination, all rights and licences granted to you under these terms will immediately cease. Your data will be handled in accordance with our Privacy Policy and applicable data retention requirements.
Sections of these terms that by their nature should survive termination (including but not limited to Intellectual Property, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution) shall continue in full force and effect after termination.
14. Modification of these terms
ManaSmurti reserves the right to modify, amend, or update these Terms of Service at any time, at our sole discretion. When we make material changes, we will:
- Update the version date at the top of this page.
- Notify registered users by email or through a prominent notice on the Platform at least 15 days before the changes take effect.
Your continued use of ManaSmurti after the effective date of any changes constitutes your acceptance of the revised terms. If you do not agree with the revised terms, you must stop using the Platform and close your account.
15. Service availability and modification
ManaSmurti makes reasonable efforts to keep the Platform available and operational. However, we do not guarantee uninterrupted or continuous availability. The Platform may be temporarily unavailable due to scheduled maintenance, upgrades, technical issues, or circumstances beyond our control.
We reserve the right to modify, update, or discontinue any feature or functionality of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part of it.
16. Third-party services and links
ManaSmurti may contain links to third-party websites, services, or resources that are not owned or controlled by us. We do not endorse and are not responsible for the content, accuracy, privacy policies, or practices of any third-party websites or services.
Your interactions with any third-party service are solely between you and that third party. ManaSmurti shall not be liable for any damage or loss arising from or in connection with your use of or reliance on any third-party content, goods, or services.
17. Force majeure
ManaSmurti shall not be liable for any failure or delay in performing its obligations under these terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of God, epidemics, pandemics, war, terrorism, riots, civil unrest, government actions or orders, power failures, internet or telecommunications failures, cyber-attacks, or failures of third-party service providers.
18. Severability, waiver, and entire agreement
Severability: If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
Waiver: The failure of ManaSmurti to enforce any right or provision of these terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these terms will be effective only if in writing and signed by ManaSmurti.
Entire agreement: These Terms of Service, together with the Privacy Policy, Refund Policy, Cookie Policy, Disclaimer, and Grievance Redressal Policy, constitute the entire agreement between you and ManaSmurti regarding your use of the Platform and supersede all prior agreements, understandings, representations, and communications, whether written or oral.
Assignment: You may not assign, transfer, or delegate your rights or obligations under these terms to any third party without our prior written consent. ManaSmurti may assign or transfer these terms, or any rights or obligations hereunder, without restriction and without notice to you.
19. Governing law and dispute resolution
These Terms of Service shall be governed by, construed, and interpreted in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts located in Bangalore (Bengaluru), Karnataka, India.
Before initiating any formal legal proceedings, the parties agree to attempt to resolve any dispute amicably through good-faith negotiation for a period of at least thirty (30) days from the date of written notice of the dispute.
Nothing in this section shall prevent ManaSmurti from seeking interim or injunctive relief from any court of competent jurisdiction to protect its intellectual property or to prevent irreparable harm.
